GENERAL CONDITIONS OF SALE
Article 1: Scope of application
These general terms and conditions of sale apply to the commercial relationship between Éditions DAVIKEN, SAS registered with the RCS of TOURS 887 950 558, whose registered office is located at 1 Kerjean Vian - 29233 Cléder, France, and the author of the order – and are valid at the time the order, for one or more works, is placed. The mere fact of placing an order implies automatic, full and unreserved acceptance of these conditions – which may be modified at any time, subject to these modifications being displayed on the site. www.daviken.com or in these conditions of sale.
Article 2: Availability of items
Items offered are subject to availability. Despite regular updates to the website and sales materials, some items may be temporarily or permanently unavailable. DAVIKEN Editions cannot be held liable for the unavailability of one or more items.
If one or more items are unavailable after the order has been placed, Éditions DAVIKEN will notify the customer as soon as possible, by email or post.
Article 3. Prices
Prices indicated on DAVIKEN Editions promotional and commercial materials are set in euros, all taxes included, excluding processing and shipping costs. They comply with the regulations applicable in France on the fixed price of books. VAT not applicable – Article 293 B of the French General Tax Code.

VAT rates applied: 5.5% for the sale of books, 10% for transfer of rights (including copyright) and 20% for any other publishing work: bookplates, art prints, reproduction of plates, etc.
Article 4. Order
Our books are available for sale or to order in all French bookstores directly from the publisher ( contact.daviken@gmail.com )
In the event of an order placed, by any available means, with Éditions DAVIKEN, the customer is deemed capable of contracting. The order confirmation constitutes acceptance and full knowledge of the general conditions of sale. Orders are fulfilled within the limits of available stocks.
In the event of a return, any damaged, spoiled or unfit copy for sale in “new condition” (photographic proof provided) will be invoiced.
Article 5: Payment
DAVIKEN Editions provides the customer with different payment methods:
- By bank transfer IBAN: FR7020041010125463545B03390 BIC: PSSTFRPPSCE
- Credit card via PayPal or Stripe (instant processing): payment is made via the secure Paypal platform via the account paypal.me/EditionsDVKN ( https://paypal.me/EditionsDVKN?locale.x=fr_FR ).
No data is transmitted or recorded by DAVIKEN Editions.
Any firm order must be paid within a maximum of 3 months upon receipt of the invoice. In the event of a deposit, if no returns or refunds have been made, the deposited copies will be payable after six months.
In the event of late payment, the buyer is liable to late payment penalties (the penalty rates depend on the key rate of the European Central Bank (ECB)) and a fixed compensation for recovery costs (€40.00) to be paid to Éditions Daviken.
Article 6. Intellectual Property
The texts and images reproduced on the Éditions DAVIKEN website are protected by copyright. Any total or partial reproduction of these protected works is prohibited. Any unauthorized reproduction or other use constitutes an infringement, punishable by the Intellectual Property Code.
Article 7: Warranty and liability
The items offered comply with current French legislation. DAVIKEN Editions declines all liability in the event of a delivered product not complying with the legislation of the destination country (censorship, ban on an author, a title, etc.). DAVIKEN Editions cannot be held liable for the content of sites to which hyperlinks on the publishers' site may refer. DAVIKEN Editions is not liable in the event of a breach of its contractual obligations due to a fortuitous event or force majeure such as a disaster, disruption, total or partial strike, in particular of postal services and means of transport, flood, fire, equipment breakdown or due to the actions of the customer. DAVIKEN Editions is not liable in the event of an error in the presentation of products on its communication or marketing materials, as the photographs, texts and illustrations representing them are not contractual.
Article 8: Protection of personal data
Data collected by any means available is processed by DAVIKEN Publishing in the strictest confidence. In accordance with the French Data Protection Act of 6 January 1978, customers have the right to access and rectify their personal data. Article 9: Applicable law and competent jurisdiction
Direct sales made by Éditions DAVIKEN through its website, social media, by email, fax, or telephone are governed by French law. Any dispute will be brought before the courts with jurisdiction for the geographical area where Éditions DAVIKEN's head office is located.
